The purpose of this document is to establish the General Terms of Use of the website www.valuatravel.com, which is owned by Valua Travel, SL (hereinafter, the OWNER), with tax ID B65903627 and registered office at C/ Muralla de Sant Llorenç, 37, 4º 1ª, Mataró, 08302 (Spain), registered in Companies Register 1, Volume 43,454, Page 212, sheet B 430405.

In order to use and register on the website, the user must be over 14 years of age or have the authorisation of their parents and/or legal guardians. Ownership (Copyright and intellectual property)

The website www.valuatravel.com is a work made up of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, etc.), the Intellectual Property of which belongs to the OWNER, except for those materials obtained under licence from third parties.

The OWNER and its licensors retain at all times the Intellectual Property of Valua Travel, SL and of the different elements that make it up, individually considered, in all copies made (whatever the medium in which they are incorporated), granting over them only the rights of use described below. Any right not expressly assigned is understood to be reserved.

In addition to the above, the OWNER is responsible for the selection, structural design and arrangement of the contents of Valua Travel, SL, and is the party that has taken the initiative and assumed the risk of making the substantial investments aimed at obtaining, digitising and presenting it, and is therefore entitled to the protection that the Intellectual Property Act (LPI) may grant over the website, considered as a database.

The OWNER is also the sole holder of the design and graphic image of Valua Travel, S.L., and reserves the legal actions to which it is entitled against persons who may make imitations or unfair uses.

The User undertakes to use this website and all its content in accordance with the law, morality, public order and these Terms of Use, and the Particular Conditions that may apply. The User also undertakes to make appropriate use of the services and/or contents of the application and not to use them to carry out unlawful or criminal activities, activities that infringe the rights of third parties and/or that breach the regulations on intellectual and industrial property, or any other rule of the applicable legal system. In particular, the User undertakes not to transmit, introduce, disseminate or make available to third parties any type of material or information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that is contrary to the law, morality or public order.

The Courts of the consumer's place of residence shall have jurisdiction to resolve any dispute.

The information or personal data you provide us about yourself will be processed in accordance with the Privacy Policy. By using the website www.valuatravel.com you consent to the processing of this information and data and declare that all the information or data you provide us is truthful and corresponds to reality.

Valua Travel, S.L., in application of the regulations in force on the protection of personal data, informs you that the personal data collected through the forms on the website www.valuatravel.com are included in the specific automated files of users of the services of Valua Travel, S.L.

The purpose of the collection and automated processing of personal data is to maintain the commercial relationship and to carry out tasks of information, training, advice and other activities of Valua Travel, S.L.

These data will only be transferred to those entities that are necessary for the sole purpose of fulfilling the purpose set out above.

Valua Travel, S.L. adopts the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

The user may at any time exercise the rights of access, objection, rectification, erasure, restriction and portability recognised in the aforementioned Regulation (EU). The user declares that all the data provided by them is true and correct, and undertakes to keep it up to date, notifying Valua Travel, S.L. of any changes.

Purpose of the processing of personal data:

At Valua Travel, S.L. we will process your personal data collected through the website www.valuatravel.com for the following purposes:

1. In the event of contracting the goods and services offered through www.valuatravel.com, to maintain the contractual relationship, as well as the management, administration, information, provision and improvement of the service.

2. Sending information requested through the forms provided on www.valuatravel.com

3. Sending newsletters, as well as commercial communications about promotions and/or advertising of www.valuatravel.com and the sector.

We remind you that you may object to receiving commercial communications by any means and at any time by sending an email to the address indicated above.

The fields in these records are mandatory, and it is impossible to carry out the stated purposes if this data is not provided.

The personal data provided will be kept for as long as the commercial relationship is maintained or you do not request its deletion, and for the period during which legal liability may arise from the services provided.

Your data is processed on the following legal bases:

• The request for information and/or the contracting of the services of Valua Travel, S.L., the terms and conditions of which will in any case be made available to you prior to any contracting.

• Free, specific, informed and unambiguous consent, in that we inform you by making this privacy policy available to you, which, after reading it, if you agree, you may accept by means of a statement or a clear affirmative action, such as ticking a box provided for this purpose.

If you do not provide us with your data, or do so incorrectly or incompletely, we will not be able to deal with your request, and it will be impossible to provide the information requested or to contract the services.

In order to use and register on the website, the user must be over 14 years of age or have the authorisation of their parents and/or legal guardians. The OWNER may contact the user at any time to ask them to prove their real age and, where applicable, to prove that they have the corresponding authorisation of their parents and/or legal guardians, for which purpose the user must provide a copy of their official identity document, as well as any other documentation that may be necessary for verification by the OWNER; if the user fails to do so, or fails to do so correctly, the OWNER may remove the user from the website.

These Terms of Use affect your legal rights and obligations. If you do not agree to comply with all the Terms of Use, do not access or use the Service.

Recipients:

The data will not be communicated to any third party outside Valua Travel, S.L., except where legally required.

As data processors, we have contracted services with providers from all over Europe, who undertook to comply with the applicable data protection regulations at the time of contracting. If you require the list of providers that operate with your data, you may request it by email to dades@valuatravel.com with the subject line "Provider Data".

In cases where the user includes files containing personal data on shared hosting servers, Valua Travel, S.L. is not responsible for the user's non-compliance with the GDPR.

Valua Travel, S.L. informs you that, as a data hosting service provider and pursuant to the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the information essential to identify the origin of the hosted data and the moment at which the provision of the service began. The retention of this data does not affect the secrecy of communications, and it may only be used in the context of a criminal investigation or to safeguard public security, being made available to the judges and/or courts or the Ministry that so requires.

Data will be communicated to the State Security Forces in accordance with the provisions of the regulations on the protection of personal data.

Valua Travel, S.L. holds all copyright, intellectual and industrial property rights, "know-how" and all other rights relating to the contents of the website www.valuatravel.com and the services offered on it, as well as to the programs necessary for its implementation and the related information.

The reproduction, publication and/or non-strictly private use of the contents, in whole or in part, of the website www.valuatravel.com is not permitted without prior written consent.

The user must respect the third-party programs made available to them by Valua Travel, S.L., even if they are free of charge and/or publicly available.

Valua Travel, S.L. holds the necessary exploitation and intellectual property rights to the software.

The user does not acquire any right or licence for the contracted service over the software necessary for the provision of the service, nor over the technical information for monitoring the service, except for the rights and licences necessary for the performance of the contracted services and only for their duration.

For any action that goes beyond the performance of the contract, the user requires written authorisation from Valua Travel, S.L., and the user is prohibited from accessing, modifying or viewing the configuration, structure and files of the servers owned by Valua Travel, S.L., assuming the civil and criminal liability arising from any incident that may occur on the servers and security systems as a direct consequence of negligent or malicious action on their part.

The use of the services provided by Valua Travel, S.L. in a manner contrary to intellectual property legislation is prohibited, and in particular:

• Use that is contrary to Spanish law or that infringes the rights of third parties.

• The publication or transmission of any content which, in the opinion of Valua Travel, S.L., is violent, obscene, abusive, illegal, racist, xenophobic or defamatory.

• Cracks, program serial numbers or any other content that infringes the intellectual property rights of third parties.

• The collection and/or use of the personal data of other users without their express consent or in breach of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

• The use of the domain's mail server and email addresses for sending unsolicited bulk email.

Valua Travel, S.L. makes backup copies of the content hosted on its servers, but is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the full restoration of data deleted by users, since such data may have been deleted and/or modified during the period of time elapsed since the last backup.

The services offered, except for specific backup services, do not include the restoration of the content kept in the backup copies made by Valua Travel, S.L. when such loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to prior acceptance by the user.

The restoration of deleted data is only included in the price of the service when the loss of content is due to causes attributable to Valua Travel, S.L.

In application of the LSSI, Valua Travel, S.L. will not send advertising or promotional communications by email or any other equivalent means of electronic communication that have not been previously requested or expressly authorised by their recipients.

In the case of users with whom there is a prior contractual relationship, Valua Travel, S.L. is authorised to send commercial communications regarding products or services of Valua Travel, S.L. that are similar to those initially contracted by the customer.

In any case, the user, after proving their identity, may request that no further commercial information be sent to them through the Customer Service channels.
